Justices Kafarati, Auta Examples of Violent Immorality How Much More Can We take?

By Bayo Oluwasanmi

The examples of Justices Abdul Kafarati and Ibrahim Auta are grisly flashback to the scenes of Sodom and Gomorrah.

April 11, 2016, SaharaReporters lead story headlined “Billionaire Judge, In Turnaround, Now To Give Saraki Judgement on Thursday” “Justice Abdul Kafarati of the Federal High Court Judge, reversing his position, will this week return to the bench to give a major ruling on the human rights case filed by embattled Senate President Bukola Saraki to stop his trial at the Code of Conduct Tribunal.”

“… the Chief Judge of the Federal High Court, Ibrahim Auta,” continues SaharaReporters, “secretly returned the case file to Justice Kafarati asking him to deliver his judgement and damn the consequences.” According to SaharaReporters, Saraki who had promised many senators that he would resign to stop further humiliation at the CCT trial changed his mind because Kafarati would deliver a judgement in his favor. SaharaReporters: “After Justice Kafarati recused himself from the case, Saraki hired several writers to keep encouraging him to deliver his ruling, which has been revealed to Saraki to be favorable.”

Kafarati, one of the dirtiest corrupt judges in the history of Nigeria, made N2 billion fortune from corruption according to the records of Economic and Financial Crimes Commission (EFCC). Kafarati is expected to rule tomorrow on the human rights case filed by Bukola Abiku Mesujamba Saraki.

Tuesday, April 12, SaharaReporters came out with another exclusive investigate bombshell: “Saraki Mobilizing Nigerian Legislators To Take Down The Federal Laws Under Which He is Being Tried” The paper reports: “In another desperate attempt to evade justice, Senate President Bukola Saraki convened a meeting last night in his home with “likeminded” Senators during which they agreed to go after two of the major laws that have ensnared him.”

Almost half a year gone since the 8th senate began and no beneficial work done for Nigerians. The sluggard and good for nothing senators came back yesterday from one of their endless series of vacation. The only priority agenda on the minds of the lawbreakers was how to salvage Bukola Abiku Mesujamba Saraki from his legal shipwreck. Two bills to amend the Constitution in favor of Mesujamba were tabled: The Code of Conduct Act CAP C15 LFN 2004 (Amendment) Bill, 2016 (SB 248) sponsored by Peoples Democratic party (PDP) Senator Peter Nwaboshi (Delta North) and The Administration of Criminal Justice Act 2015 (Amendment) Bill 2016 (SB 249), sponsored by Senator Isah Misau  representing Bauchi Central.

Dino Melaye who paid over $1,000 from his US bank account to remove tattoo from the body of one her ex-girl friends, was the convener of the meeting. Mesujamba continues to lubricate the wheels of his corruption machine to buy and sustain the loyalty of his core support group. “During the meeting at Saraki’s home,” reports SaharaReporters, “he took the opportunity to announce to members of his core support group that he has ordered the purchase of Toyota Landcruiser V8 engine Sport Utility vehicles to be given to each Senator. “… That 36 cars,” continues SaharaReporters, “have already been purchased, each one costing N35 million each.”

It is an immoral violence unleashed on Nigerians by shameless, faceless, spineless, dirty and corrupt justices Kafarati and Auta unworthy of a judge’s robe who are determined to ram down our throats legal poison as if they have more brains and power than our people and our choices of representative government.

What gives them the right? Does their actions even make legal or moral sense? They are setting precedence of judges imagining what the law should be, according to their own particular biases, bribery, destroying the meaning of the supremacy of the law. This is one more example of a long stream of horrible abuses by our courts.

How much more must we take? The judges derive their powers from the consent of the governed. Once they have become destructive, it is our right to chase them out of the bench, disrobe them, and throw them nakedly into the streets and be stoned. Their long train of abuses and usurpation have turned a democratically elected government into despotism. Our patience has dried up. Such is now the necessity to take the laws into our own hands and fight these Absaloms by any means necessary.

Nigerians must insist that President Buhari remove these mercenary judges for unethical, immoral behavior. We must remind the President that he must get rid of these saboteur judges who convert the  constitutional power vested in them by the Nigerian people, and use same to subvert the legally binding Supreme Court ruling which cleared the way for the prosecution of Bukola Abiku Mesujamba Saraki to the fullest extent of the law. If I may remind the brainless judges, the Constitution sets up the judicial branch with provision for a single Supreme Court, which allows the lesser federal courts to exist as subordinates. The Constitution also established the fact that judicial powers of the federal government shall be vested in the Supreme Court, and such inferior courts like the Kafarati and Auta courts must defer and abide by the Supreme Court decision.

If we’re silent, we’re complicit. Where are the Civil Liberty Organizations?  Where are the Human Rights Groups? This is the best opportunity to mobilize Nigerian masses in reeling the bastard judges and force them out of the judiciary. The fact that we have a National Asylum full of inmates as opposed to National Assembly with rational human beings, Nigerian people will have to do the physical cleaning as well as spiritual cleansing of the hollow chambers. The judges, the Mesujambas, and their co-conspirators are entrenched with the faulty reasoning that Nigerians cannot fight Kafarati and Auta and their other corrupt judicial siblings. Now is the time to prove them wrong.

We have the Constitutional powers. Our duty is to remove individuals like Kafarati and Auta who are trampling on the law as legislated. The cash and carry judges and the Senate of crooks and cabals must be held accountable. If not, our freedoms are history. We will get only those freedoms allowed to us by judicial tyrants a.k.a. Kafarati and Auta. “Bad men cannot make good citizens,” Patrick Henry warned us. “it is impossible that a nation of infidels or idolaters should be a nation of free-men. It is when a people forget God,” says Henry, “that tyrants forge their chains. A vitiated state of morals, a corrupted public conscience, is incompatible with freedom,” said Henry.

For the dumb Kafarati and Auta, let me remind them again that a Supreme Court judgement has one purpose and one purpose only: to adjudicate the Constitution, to render a judgement, to resolve a disputation between the law in the ruling of the lower court, on one hand, and on the other, the law, in the Constitution of the Federal Republic of Nigeria. It is the job of the Supreme Court to determine whether the law, in this case, the Constitution has been violated. That’s all. That’s it. End of issue. Why the hell are the Kafaratis and Autas tampering and twisting the Supreme Court decision on Bukola Abiku Mesujamba Saraki’s case?

It doesn’t matter how much money Bukola Abiku Mesujamba Saraki paid Kafarati and Auta. It only matters what the Constitution and the law say. That’s what the Supreme Court had decided many months ago. How could Kafarati and Auta support such an evil? Because they are evil. Kafarati and Auta – out of control judges – are examples of profound tyranny who have no shame, no conscience, and are above their oath of the Constitution. These lunatic judges have acted without prudence, discretion, and without proper regard to the overwhelming support of millions of Nigerians who support the prosecution of Bukola Abiku Mesujamba Saraki based on his violation of the laws of the land. How much more are we going to take? Our corrupt judicial system not only violates the basic rights of poor Nigerians to equality before the law, but denies them procedural rights guaranteed by our Constitution.

Nigeria has the most crooked, dishonest, dangerous, and corrupt judicial system of any nation. Judicial corruption is covering Nigeria like a blanket. We’re now witnessing an imperial, unfettered, arrogant, and malevolent judiciary makes it way down from Supreme Court to the trashy, filthy, and threadbare courtrooms of Kafarati and Auta. We must get rid of the Kafaratis and Autas in our judicial system.

How much more must we take?
