Tribunal Sacks PPN Assembly Man John Obafemi

The National and State Assembly Election Petitions Tribunal sitting in Abeokuta on Wednesday, removed a member of the State Assembly, Mr John Obafemi, of the PPN.

The victory of Obafemi, representing Remo North Constituency, was challenged by Mr Samuel Oshinmade of the PDP.

Oshinmade, who approached the court through his counsel, Mr Tayo Amoo, in a petition, said that the election of Obafemi lacked the requirement of the Electoral Acts.

He alleged that there were multiple voting, bribery, over voting and also deductions of about 300 votes that belonged to him.

He said the tribunal would not find it difficult to declare him winner if the 300 votes were added.

He, thereafter, prayed the court to declare him winner of the election held on April 26.

During the trial, however, the Counsel to PPN, Mr Ojo Akinwale, refuted the allegations, saing that they could not be proved beyond doubt.

Akinwale prayed the court to quash the petition, saying that it was incompetent and ought to be struck out.

The Chairman of the tribunal, Mrs Elizabeth Karatu-Abebe, said that the petitioner had refused to prove beyond doubt issues of bribery as alleged.

She, however, said that the tribunal was convinced beyond doubt that the petitioner had been able to prove issues of over voting and non-compliance with the Electoral Act.

Karatu-Abebe said the petitioner had been able to establish issues of non-compliance with the Act.

She added that evidences before the court was enough to show that 300 votes that belonged to the petitioner were illegally deducted.

The Chairman said if the 300 votes from ward 8 of the constituency were added, the petitioner would score 4,080 as against the respondents 4,045.

She, thereafter, declared the petitioner, Samuel Oshinmade, winner of Remo the constituency.
