APM’s petition against Tinubu incompetent – PEPC

..strikes out case

The Presidential Election Petition Court, PEPC, sitting in Abuja, has dismissed as incompetent, the case the Allied Peoples Movement, APM, filed to nullify President Bola Tinubu’s election.

The court held that issues the APM raised in its petition contained pre-election matters that could only be determined by the Federal High Court.

The Presidential Petition Election Tribunal, headed by Justice Haruna Tsammani, emphasized that this matter should have been raised prior to the presidential election.

He said, “The issue of qualification or disqualification is a constitutional one.

The issue of disqualification or qualification is a pre-election matter.

“It must be determined before the conduct of the election. This court has no jurisdiction to hear the matter and even if it does it is status-barred because it is a pre-election matter.”
