NDLEA Urges Court To Dismiss PDP’s Suit, Says Tinubu Was Never Prosecuted In US

The National Drug Law Enforcement Agency (NDLEA) has asked a federal high court in Abuja to dismiss a suit filed by the Peoples Democratic Party (PDP) against President-elect Bola Tinubu. The PDP and Dino Melaye, a chieftain of the party, had filed an order of mandamus to compel the NDLEA to arrest and prosecute Tinubu over an alleged forfeiture of funds relating to narcotics trafficking in the US. In a preliminary objection filed on Wednesday, Joseph Sunday, director of prosecution of the NDLEA, said the application by the PDP and Melaye is “incompetent” and that the court lacks the jurisdiction to entertain it. The National Economic Council (NEC), presided over by Vice-President Yemi Osinbajo, has agreed that the removal of petrol subsidy should be suspended temporarily. NEC, however, said all of the preparatory works should continue in consultation with the states and other key stakeholders, including representatives of the incoming administration. The resolution comes just two months to the scheduled time for the removal of the costly petrol subsidy – also called under-recovery. A Federal High Court in Lagos, on Wednesday, struck out an interim order of forfeiture obtained by the Economic and Financial Crimes Commission, EFCC, seeking to seize 14 properties allegedly linked to Governor Yahaya Bello of Kogi State. Justice Nicholas Oweibo struck out the suit on the ground that Section 308 of the 1999 Constitution prevents the institution of any criminal or civil case against a sitting governor or the President.
